Vivas Lloreda, William Yeffer2021-12-292021-12-292021-12-292304-2494La consulta previa como fundamental de titularidad colectiva de los pueblos étnicos, se constituye en un instrumento de defesa de no solo del territorio de las minorías étnicas, sino en un instrumento, derecho fundamental y derecho humano que propicia la defensa de otros derechos básicos de la comunidad y de sus miembros como la cultura, creencias, integridad personal, seguridad alimentaria y pervivencia misma, para ello la consulta previa debería convertirse en un derecho efectivo de protección material y no un derecho de protección meramente formal. Hacer del derecho a la consulta previa un mecanismo o derecho de protección únicamente formal, se constituiría en un instrumento de negación de otros derechos protegidos en la Constitución política de Colombia y en instrumento internacionales como la convención americana de derechos humanos, por ello en este articulo buscando generar un documento que motiva la transformación de este instrumento jurídico de protección formal a convertirse en un instrumento de protección efectiva, de protección material de derechos, en distintos ordenamientos jurídicos.Prior consultation, as fundamental to the collective ownership of ethnic peoples, constitutes an instrument of defense of not only the territory of ethnic minorities, but also an instrument, a fundamental right and a human right that fosters the defense of other basic rights of the community and its members such as culture, beliefs, personal integrity, food security and survival itself, for this, prior consultation should become an effective right of material protection and not a merely formal right of protection.
